These terms apply to apexsportsandcourts.com and to court bookings with Apex Sports & Courts, 312 Harbor Blvd, Suite 312, Belmont, CA 94002 ("Apex," "we," "us"). By using the site or booking with us, you agree to these terms.

Using this website

• Use the site for lawful, personal purposes, such as learning about the facility, contacting us, and booking court time.
• Please don't try to break, overload, or scrape the site, or send spam through our forms.
• We work to keep everything accurate, but hours, prices, programs, and opening dates can change. Pages marked as a preview aren't final offers.
• The Apex name, logo, photos, and site content belong to Apex Sports & Courts or are used with permission. Please don't reuse them without asking.
• Links to other sites, like Instagram, are there for convenience. We aren't responsible for their content or policies.

Bookings and court use

When you book court time, a package, or equipment, your booking is governed by:

• The booking terms shown at checkout
• Our Facility Rules, Policies & Code of Conduct and Court-Specific Rules
• Our 24-hour cancellation policy and refund & credit terms
• The participant waiver and release, which every participant must sign before playing (a parent or legal guardian signs for minors). Read the waiver summary.

The person who makes a booking is responsible for making sure everyone in their group has signed the waiver, follows the rules, and that the group stays within our 50-person maximum occupancy. Minors must be supervised by a responsible adult at all times.

We may refuse or end facility access for anyone who breaks the rules or puts others at risk, consistent with applicable law.

Disclaimers

The website is provided as is. We do our best to keep it running and accurate, but we can't promise it will always be available or error free.

Sports involve inherent risks of injury. Please play within your abilities, follow staff instructions, and report any injury or hazard right away.

Limitation of liability

To the fullest extent permitted by law, Apex is not liable for indirect, incidental, or consequential damages arising from your use of the website. For website-related claims, our total liability is limited to the amount you paid us, if any, in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited under California law, including liability for our own gross negligence, fraud, or willful misconduct, or your rights as a consumer. Liability related to facility use is also addressed in the participant waiver and release, only to the extent the law allows.

Governing law

These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in San Mateo County, California, unless the law requires otherwise.

Changes

We may update these terms from time to time. The current version will always be posted here with the date at the top. Changes don't affect bookings already confirmed under earlier terms.
